Treatment and Trade Mark Use on Wooden Packing

As of February 2, 2004, all imported cargo that is transported on platforms or
wooden packing materials, will be subject to a visual inspection by the Federal Bureau of Environmental Protection ('PROFEPA').

On November 26 and December 18, 2003 respectively, the Ministry of the
Environment and Natural Resources ('SEMARNAT'), published in the Official Federal Gazette Emergency Mexican Official Standard NOM-EM-144-SEMARNAT ('NOM-EM-144'), that establishes the technical specifications for phytosanitary measures (treatment) and trademark use that certifies its application regarding wooden packing material used in foreign trade, and the "Accord that establishes the procedure and requirements for authorizing the trademark that certifies the application of phytosanitary measures for wooden packing materials used in foreign trade, provisions that became effective on the day following their publication.

Since it is very common to use of wooden packing materials with non-manufactured wood lacking treatment to eliminate living pests contained in raw or recently cut wood, and since Canada, the United States of America and Mexico as members of the North America Organization for the Protection of Plants (NAPO), on April 2003 agreed to implement from January 2, 2004 measurements to adopt the Standard related to "Guidelines to Regulate the Wooden Packing used in Foreign Trade (NIM 015), Mexico was committed to comply with this provision.

Authorized companies will be registered in the National Forest/Timber Registry and will be eligible to use the Trademark for wooden packing materials. This will certify compliance with the treatment established by NOM-EM-144. PROFEPA will verify compliance with the Accord.

The following goods are exempt for compliance with NOM-EM-144: wooden packing
materials completely made from manufactured wood, such as plywood, particle boards of oriented fiber boards or sheet panels manufactured with glue, heat or pressure or with a combination thereof, and central panels, sawdust, shaving and raw wood cut in pieces with a thickness equal or less than 6 mm (6 millimeters).
