Environmental

The import and export of certain pesticides, vegetable fertilizers and hazardous substances and materials is subject to prior authorization of the Ministry of Environment and Natural Resources ("SEMARNAT"), pursuant to the provisions included in the Administrative Rule that establishes the classification and codification of goods whose importation is subject to regulations by the governmental agencies that make up the Inter-Ministry Commission for the Control of the Process and Use of Pesticides, Fertilizers and Toxic Substances.

Regarding the above, the SEMARNAT published in the Federal Official Gazette of March 29, 2006, the official instruction manuals and applications required in order to obtain the import or export authorization for pesticides, vegetable fertilizers and hazardous substances and materials.

The published applications and instruction manuals are applicable to the following procedures:

I. Request for an import authorization for pesticides, vegetable fertilizers, and hazardous substances and materials;
II. Request for an export authorization for pesticides, vegetable fertilizers, and hazardous substances and materials; and
III. Notice of modification of customs office for the import of pesticides, vegetable fertilizers, and hazardous substances and materials.

It is important to point out that such applications were previously published by SEMARNAT in its web site on November 15, 2005.

Nevertheless, the Regulations for Registries, Import and Export Authorizations, and Export Certificates of Pesticides, Vegetable Fertilizers, and Hazardous or Toxic Substances and Materials provide that such applications should be published in the Federal Official Gazette, which is the reason for this publication.

The procedures that were started before the publication of this Agreement will be considered valid.
